The accommodation contract is concluded directly between the Guest and the Accommodation Provider. Any external technical, payment or booking systems serve solely to process the booking, payment or communication and are not providers of the accommodation.

1. Making a Booking

1.1. The Guest may make a booking via the online booking system on the Accommodation Provider's website or in another manner approved by the Accommodation Provider.

1.2. Before completing the booking, the Guest is obliged to check in particular:

  • the selected apartment,
  • the arrival and departure dates,
  • the number of adults and children,
  • the age of children, if required,
  • the price of the stay,
  • the selected rate,
  • the payment terms,
  • the cancellation terms,
  • additional services and fees,
  • contact and billing details.

1.3. The Guest is responsible for the accuracy and completeness of the information provided in the booking.

1.4. The booking becomes binding at the moment the Guest receives the booking confirmation at the e-mail address provided by the Guest.

1.5. If confirmation of the booking is conditional upon payment of the full price, payment of a deposit or successful verification of the payment method, the booking becomes binding only once this condition has been met and the booking confirmation has subsequently been sent.

1.6. The mere submission of a non-binding enquiry does not constitute an accommodation contract.

2. Price of the Stay

2.1. The price of the stay is stated in the booking process before the booking is bindingly completed.

2.2. Before completing the booking, the Guest receives a summary containing in particular:

  • the price of accommodation,
  • the price of additional services,
  • applicable taxes,
  • mandatory fees,
  • the total amount payable.

2.3. If any fee is payable separately on arrival or during the stay, this will be stated in the booking process or in the booking confirmation.

2.4. The price stated in the booking confirmation is binding for the respective booking.

2.5. Prices are stated in euros (EUR), including applicable taxes. Any conversions of the price into another currency are for information purposes only. The amount in euros stated in the booking confirmation is decisive.

3. Payment Terms

3.1. The method and due date of payment depend on the selected rate and are displayed to the Guest before the booking is completed.

3.2. Unless stated otherwise in the specific offer or in the booking confirmation, the full price of the stay is payable in advance by the due date stated in the booking acknowledgement (as a rule within a few days of booking and no later than the day before arrival). For an individual offer, the Accommodation Provider may agree a different payment arrangement with the Guest, e.g. a deposit and payment of the balance before arrival.

3.3. Payment is made exclusively by bank transfer in euros (SEPA credit transfer) to the Accommodation Provider's account stated in the booking acknowledgement. The acknowledgement also contains an EPC QR code that can be scanned in a banking app. The Guest shall state the booking number as the payment reference. The Accommodation Provider does not accept payment by card or through payment gateways. Any charges of the Guest's bank are borne by the Guest.

3.4. The booking is confirmed once the payment has been credited to the Accommodation Provider's account. Until the due date stated in the booking acknowledgement, the Accommodation Provider holds the dates for the Guest; if the payment has not been credited by then, the booking is cancelled without further notice.

3.5. The Guest may only use a means of payment which the Guest is authorised to use.

3.6. If the required payment is not made properly and on time, the booking may not be confirmed or may be cancelled in accordance with the terms of the specific rate.

3.7. The Accommodation Provider will issue to the Guest the appropriate receipt for the payment received in accordance with applicable legislation.

3.8. Additional services ordered by the Guest during the stay (in particular cleaning during the stay, change of bed linen, late check-out and other services offered in the "Můj apartmán" (My apartment) app) are charged at the price stated for the service at the time of the order. By ordering a service, the Guest undertakes to pay its price. Additional services are paid in advance by bank transfer (with an EPC QR code) immediately after ordering; the Guest receives the payment details in the Můj apartmán app and by e-mail. After departure, the Guest will receive a statement of the stay by e-mail; any outstanding amount, charges and contractual penalties under Art. 10 are due no later than the day after the statement is sent. Accommodation, parking (where available at the property) and final cleaning are included in the price of the stay.

4. Rates

4.1. The Accommodation Provider may offer various rates, in particular:

  • a flexible rate,
  • a non-refundable rate,
  • a long-stay rate,
  • an individual or discounted offer.

4.2. For each rate, the following must be stated before the booking is completed:

  • what the price includes,
  • the due date and method of payment,
  • the possibility of changing the booking,
  • the cancellation terms,
  • the conditions for any refund of the amount paid.

4.3. An amount paid is not automatically non-refundable. Whether it can be refunded is governed by the terms of the selected rate.

4.4. Under a non-refundable rate, the Guest is not entitled to a refund of the amount paid if the stay is cancelled or not used, unless stated otherwise in the booking confirmation.

5. Changes to a Booking

5.1. The Guest must notify the Accommodation Provider of any request to change the booking as soon as possible.

5.2. A change to the booking is only possible subject to current availability and the terms of the selected rate.

5.3. A change of dates, apartment, number of guests or ordered services may result in a change of price.

5.4. There is no automatic entitlement to a change of booking.

5.5. A change becomes valid only once it has been confirmed in writing by the Accommodation Provider.

6. Cancellation by the Guest

6.1. The Guest may cancel the booking in the manner stated in the booking confirmation or by using the Accommodation Provider's contact details.

6.2. The amount of the cancellation fee is governed by the terms of the specific rate, of which the Guest was informed before completing the booking.

6.3. The cancellation terms stated in the booking confirmation are decisive.

6.4. If the Guest fails to arrive for the stay without having cancelled the booking in advance, this constitutes a failure to arrive, i.e. a "no-show". The Accommodation Provider may charge a cancellation fee in accordance with the terms of the selected rate.

6.5. Early termination of the stay by the Guest does not give rise to an automatic entitlement to a refund for unused nights or services.

7. Cancellation by the Accommodation Provider

7.1. Before confirmation, the Accommodation Provider may decline a booking, in particular in the event of:

  • unavailability of the selected apartment,
  • an unsuccessful or unmade payment,
  • incomplete or manifestly incorrect information,
  • reasonable suspicion of fraudulent or unlawful conduct,
  • an obvious technical error in the price or availability.

7.2. The Accommodation Provider may cancel a confirmed booking only for serious reasons, in particular if an extraordinary circumstance occurs that makes it impossible to provide the accommodation.

7.3. If the Accommodation Provider is unable to provide confirmed accommodation for reasons on its side, it will offer the Guest, depending on the specific circumstances:

  • comparable alternative accommodation,
  • a change of dates,
  • or a refund of the amount paid for services not provided.

7.4. The Guest's statutory rights remain unaffected.

8. Arrival and Departure

8.1. Arrival and departure times are stated in the accommodation offer and in the booking confirmation.

8.2. The Guest is obliged to inform the Accommodation Provider of any significant change in the expected time of arrival.

8.3. In the case of self check-in, the Guest will receive access instructions before the start of the stay, as a rule after:

  • full payment of the required price,
  • provision of the details of the persons staying,
  • fulfilment of other registration obligations.

8.4. The Guest is obliged to protect the keys, access cards and access codes provided against loss and misuse.

8.5. Early arrival or late departure is only possible by prior arrangement with the Accommodation Provider.

8.6. Traveller registration: Under Spanish law (Organic Law 4/2015 and Royal Decree 933/2021), the Accommodation Provider must record the details of all persons staying and transmit them to the Spanish Ministry of the Interior via the SES.Hospedajes system. Before the start of the stay (as a rule as part of the online check-in), the Guest must provide the required details of himself or herself and of all persons staying, including the details of a valid identity document (ID card or passport) for the persons for whom the regulations require it. For minors, the relationship to the accompanying adult is also recorded.

8.7. Without the details under Art. 8.6, the Accommodation Provider cannot provide the accommodation and will not release the access details. The Accommodation Provider is entitled to verify the Guest's identity against an identity document. Details of how this data is processed are set out in the Privacy Policy.

9. Obligations of the Guest

9.1. The Guest is obliged to:

  • comply with the accommodation rules and house rules,
  • use the apartment properly and solely for accommodation purposes,
  • respect the maximum permitted number of persons,
  • not allow unregistered persons to stay without the Accommodation Provider's consent,
  • observe quiet hours at night,
  • respect the smoking ban,
  • respect the rules for pets,
  • not hold celebrations or parties without prior consent,
  • report any defect or damage without undue delay,
  • on departure, leave the apartment in a condition corresponding to normal use.

9.2. The Guest is responsible for the conduct of the persons using the accommodation together with the Guest.

9.3. The Accommodation Provider may terminate the stay without compensation if the Guest seriously or repeatedly breaches the accommodation rules, damages property, endangers the safety of persons or materially disturbs the night-time quiet.

9.4. A pet is allowed only if it is declared at the time of booking. A maximum of 1 pet weighing up to 10 kg is allowed, for a fee of 15 € per night, which is part of the price of the stay. The pet must not be allowed on beds or upholstered furniture, must not be left alone in the apartment, and the Guest is liable for any damage it causes. A pet not declared in the booking or exceeding the weight limit is a breach of these terms (art. 10.6) and the Accommodation Provider may refuse its stay.

10. Security Deposit, Liability for Damage and Penalties

10.1. If a refundable security deposit is required, its amount, the method of payment and the conditions for its return will be stated before the booking is completed.

10.2. The Guest is liable for damage caused by the Guest or by persons to whom the Guest has given access to the apartment.

10.3. The Accommodation Provider may claim compensation in particular for:

  • damaged or missing equipment,
  • lost keys or access devices,
  • extraordinary cleaning,
  • remedying the consequences of smoking,
  • damage caused by an unauthorised animal,
  • damage incurred in connection with an unauthorised party,
  • other demonstrably incurred damage.

10.4. If the amount of damage exceeds the security deposit paid, the Accommodation Provider may demand payment of the difference.

10.5. The security deposit does not serve as a lump-sum contractual penalty and may only be used in accordance with the agreed terms and the claims of the Accommodation Provider that have arisen.

10.6. In the event of a breach of obligations under these terms, the Guest undertakes to pay the Accommodation Provider the following lump-sum charges and contractual penalties:

  • Loss of a key, chip or remote control: 50 € per item,
  • Departure after check-out time without a booked late check-out: 100 €,
  • Smoking in the apartment (ozone treatment and extra cleaning): 150 €,
  • Unauthorised pet: 75 €,
  • Unregistered additional person: 50 € per person per night,
  • Extra cleaning due to excessive soiling: 75 €,
  • Unauthorised party or repeated disturbance of night-time quiet: 150 €.

10.7. If the Guest is late in paying the invoice for additional services, charges or contractual penalties, the Guest shall pay a contractual penalty of 5 % of the outstanding amount for each day of delay. Before applying the penalty, the Accommodation Provider will send the Guest a reminder by e-mail.

10.8. Charges and contractual penalties under Art. 10.6 and 10.7 will be invoiced to the Guest by e-mail together with the additional services (Art. 3.8), stating the reason. Payment of a contractual penalty does not affect the Accommodation Provider's right to compensation for damage exceeding the penalty. A contractual penalty shall not apply if the breach was caused by the Accommodation Provider or by circumstances beyond the Guest's control.

11. Defects in Accommodation and Complaints

11.1. The Guest is obliged to report any defect or problem without undue delay so that the Accommodation Provider has the opportunity to remedy it during the stay.

11.2. The Accommodation Provider undertakes to resolve a reported problem within a reasonable time, depending on its nature.

11.3. A complaint may be submitted:

  • by e-mail to info@marresidences.com,
  • in writing to the address of the Accommodation Provider's registered office,
  • via the contact stated in the booking confirmation.

11.4. A complaint should contain:

  • the Guest's name,
  • the booking number,
  • a description of the defect or problem,
  • the date it was discovered,
  • the requested remedy,
  • photographs, if available.

11.5. A complaint will be handled without undue delay, and no later than within the statutory time limit, unless the Accommodation Provider and the Guest agree otherwise.

11.6. In accordance with Andalusian consumer-protection rules, official complaint forms (hojas de quejas y reclamaciones) are available at each property. The Accommodation Provider will hand them to the Guest without delay on request. A completed form can be handed to the Accommodation Provider and subsequently submitted to the competent consumer authority of Andalusia (Junta de Andalucía – Consumo).

12. Personal Data

12.1. The Accommodation Provider processes personal data in particular for the purposes of:

  • creating and performing the booking,
  • providing the accommodation,
  • communicating with the Guest,
  • receiving and reconciling payments,
  • complying with accounting and tax obligations,
  • registering travellers and transmitting their data to the Spanish Ministry of the Interior (SES.Hospedajes),
  • handling complaints and legal claims.

12.2. To the extent necessary, personal data may be processed by providers of hosting, e-mail, accounting and banking services.

12.3. Detailed information, including the right to lodge a complaint with the Spanish supervisory authority AEPD, is set out in the Privacy Policy. Information on cookies is set out in the Cookie Policy.

12.4. Personal data are not used to send marketing communications without an appropriate legal basis.

13. Complaints and Out-of-Court Resolution of Consumer Disputes

13.1. The Accommodation Provider recommends that the Guest first contact the Accommodation Provider directly (Art. 11) and try to resolve the dispute amicably.

13.2. A Guest who is a consumer may file a complaint using a hoja de quejas y reclamaciones (Art. 11.6) or contact the consumer authorities of Andalusia (Junta de Andalucía – Consumo) or a municipal consumer information office (OMIC). Consumer disputes may also be resolved through consumer arbitration (Junta Arbitral de Consumo); participation is voluntary. [The Accommodation Provider will state whether it adheres to the Consumer Arbitration System (Sistema Arbitral de Consumo).]

13.3. For cross-border disputes, the Guest may use the free assistance of the European Consumer Centres (ECC-Net; in Spain the Centro Europeo del Consumidor en España). The EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025.

14. Withdrawal from the Contract

14.1. In accordance with Article 103(l) of the Spanish consumer protection act (Real Decreto Legislativo 1/2007, TRLGDCU) and the relevant EU rules, the Guest as a consumer has no right to withdraw from the accommodation contract within 14 days without giving reasons where the accommodation is to be provided on a specific date or within a specific period.

14.2. The possibility of cancelling the booking and of any refund of the price paid is governed by the cancellation terms of the selected rate.

15. Final Provisions

15.1. The contractual relationship between the Accommodation Provider and the Guest is governed by Spanish law. Where the Guest is a consumer, this does not affect the mandatory consumer-protection provisions applicable to the Guest.

15.2. Disputes shall be heard by the courts having jurisdiction under the applicable rules. Where the Guest is a consumer, the Guest may not be deprived of the rights concerning jurisdiction granted by mandatory consumer-protection rules.

15.3. The terms valid at the time a booking is completed apply to that booking.

15.4. The Accommodation Provider may amend these terms. Amendments have no retroactive effect on bookings already confirmed.

15.5. These terms are available on the Accommodation Provider's website. The Guest will receive their wording, or a link enabling them to be saved, together with the booking confirmation.

15.6. Individual terms stated in the booking confirmation take precedence over the general provisions of these terms.

15.7. If any provision is invalid or ineffective, this does not affect the validity of the remaining provisions.

15.8. These terms are drawn up in Spanish, Czech and English. In the event of any discrepancy between the language versions, the Spanish version prevails.
